Rudder S.A.M., with registered office in “Le Panorama”, Block A/B, 57 rue Grimaldi, MC 98000, MONACO, is the Data Controller for the personal data collected on this website, pursuant to and for the purposes of Regulation (EU) 2016/679 (GDPR).

In line with the commitment and care that Rudder S.A.M. dedicates to protecting personal data, we inform you about the methods, purposes, and scope of communication and disclosure of your personal data, as well as your rights, in accordance with Article 13 of the GDPR.

1. Categories of Personal Data Processed by the Data Controller

To provide the services offered through its websites, Rudder S.A.M., as Data Controller, must process certain personal data necessary for the provision of its services.

This data may be provided implicitly through the tools you use to access and use the services, or may be provided explicitly by you.

Rudder S.A.M. may process the following categories of user personal data:

  • technical browsing data relating to IP address, device identification codes used to access the site or services, browser characteristics, and access times;
  • browsing data for profiling purposes, provided indirectly through your use of the service and obtained and analyzed with your prior consent;
  • common identifying data provided by the user (e.g., first name, last name, email, phone number, etc.) for the use of products and services.

2. Purposes and Legal Bases of Processing

The data and cookies collected from you will be processed by Rudder S.A.M. solely using the methods and procedures necessary to provide the services you have requested or subscribed to (Contractual Purposes), and for any further purposes for which you have given your consent.

Only with your express consent may your data be used to carry out statistical analysis, market research, promotional activities through social media, and the sending of commercial information about Rudder S.A.M.’s products and promotional initiatives. (Direct Marketing Purposes)

Also with your consent, your data may be used for profiling purposes carried out automatically by collecting information about your browsing during access to and use of the service and, through statistical correlation algorithms, linking it to the same information from other users in order to identify common traits and group similar users into interest classes. By assigning your browser to an interest class, our systems will subsequently be able to offer you content closer to your preferences and display advertising content that better matches your needs and better targets advertisers’ interests, reducing disruption to your experience.

As of the date you read this Notice, Rudder S.A.M. uses profiling data to build marketing profiles, to manage relationships with advertising partners and improve their campaigns, to infer usage patterns for our products and services, and to support commercial departments in developing digital strategies. Finally, with your explicit consent, your data may be provided to other companies operating in the publishing, financial, automotive insurance, energy, consumer goods, and humanitarian/charitable sectors, which may contact you as independent Data Controllers of their own initiatives — an updated list is available on request from the Data Processor at the address below — for statistical analysis, market research, and the sending of commercial information about products and promotional initiatives. Communications for market research or commercial information about products and promotional initiatives may be carried out via postal mail, email, telemarketing, SMS, and MMS.

Please note that some activities may be carried out through suppliers specifically appointed as Data Processors, including those residing outside the European Union.

The legal bases for the purposes described above are the performance of a request made by you as the data subject, and the consent you have given.

3. Disclosure, Communication, and Parties with Access to Your Data

Your personal data will not be disseminated, but may be disclosed, where necessary for the provision of the service, to third parties (such as third-party technical service providers, postal couriers, hosting providers, IT companies) appointed, where necessary, as Data Processors by Rudder S.A.M. for technical or organizational tasks instrumental to the provision of the services.

Access to the data is also granted to categories of personnel authorized by Rudder S.A.M. involved in data processing activities (administrative, sales, marketing, customer service staff, and system administrators).

The updated list of Data Processors may always be requested from the Data Controller.

The right to disclose data to third parties remains reserved where you have given your specific and optional consent.

4. International Data Transfers

Your personal data will be processed by Rudder S.A.M. within the territory of the European Union.

Where, for technical and/or operational reasons, it becomes necessary to make use of parties located outside the European Union, or to transfer some of the data collected to technical systems and cloud-based services located outside the European Union, such processing will be carried out in accordance with Chapter V of the Regulation and authorized on the basis of specific European Union decisions. All necessary precautions will therefore be taken to ensure the fullest protection of personal data, basing such transfers on: a) adequacy decisions issued by the European Commission regarding the recipient third countries; b) appropriate safeguards provided by the third-party recipient pursuant to Article 46 of the Regulation; c) the adoption of binding corporate rules.

5. Duration of Processing and Data Retention

In accordance with Article 5(1)(e) of the GDPR, Rudder S.A.M. will process the data you provide for the entire duration of the requested services and will retain it for the following 6 months for the purpose of completing administrative activities, as well as for the time necessary to fulfill legal obligations and to protect its legal rights.

Where you have authorized profiling, the anonymous data observed from time to time will be deleted 12 months after the start of processing.

6. Rights of the Data Subject

Rudder S.A.M. guarantees that you may exercise, at any time, the rights set out in Article 12 of the GDPR. In particular, you have the right:

  • to know whether the Data Controller holds and/or processes personal data relating to you, and to access it in full, including obtaining a copy (Art. 15, Right of Access);
  • to rectification of inaccurate personal data or completion of incomplete personal data (Art. 16, Right to Rectification);
  • to erasure of personal data held by the Data Controller where one of the grounds set out in the GDPR applies (Art. 17, Right to Erasure);
  • to request that the Data Controller restrict processing to only certain personal data, where one of the grounds set out in the Regulation applies (Art. 18, Right to Restriction of Processing);
  • to request and receive all your personal data processed by the Data Controller, in a structured, commonly used, machine-readable format, or to request its transmission to another controller without hindrance (Art. 20, Right to Data Portability);
  • to object, in whole or in part, to the processing of data for the purpose of sending advertising material and conducting market research (based on Consent) (Art. 21, Right to Object);
  • to object, in whole or in part, to automated or semi-automated processing of data for profiling purposes (based on Consent).

You also always have the right to lodge a complaint with the Data Protection Authority (Garante per la Protezione dei Dati Personali), which can be reached at garante@gpdp.it or via the website http://www.gpdp.it.
